JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 447, 504, 379 and 34 of the Indian Penal Code read with Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the petitioners is to have assaulted the informant with lathi and danda, abused him by his caste name and snatched Rs.1000/- from him.

It has been submitted on behalf of the petitioners that they have been falsely implicated in the present case due to previous enmity between the parties. Allegation of committing theft of Rs.1000/- has been denied. As far as offence under SC and ST Act is concerned, same is not made out against the petitioners and offence of other Sections are bailable. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

No.39712 of 2015 (2) dt.30-09-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Jurawanpur P.S. Case no. 16 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
