JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2018 The petitioner seeks regular bail in connection with University (P.S.) Darbhanga, G.O. Case No. 789/2018 and P.R. No. 25/2018, registered for offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 48.9 litres of liquor from the verandah of the house of the petitioner.

It has been submitted on behalf of the petitioner that she is old widow lady and has falsely been made accused in this case and from the F.I.R. itself it is evident that the recovery has been made from the Verandah of the house. She has been in judicial custody since 10.09.2018 and has no criminal antecedent. Heard learned A.P.P. also.

No.63620 of 2018 (2) dt.25-10-2018 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IV cum Special Judge, Darbhanga, in connection with University (P.S.) Darbhanga, G.O. Case No. 789/2018 and P.R. No. 25/2018, subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) It is made clear that if the petitioner again transpires in any of the like offences, in future, prosecution will be free to move for cancellation of her bail bonds.
