The report of learned Additional Sessions Judge goes to show that trial of the petitioner has already commenced and out of 7 prosecution witnesses; two prosecution witnesses including the informant have already been examined. The trial court has also reported that summonses and other processes have already been issued to procure the attendance of prosecution witnesses. Considering the aforesaid facts and circumstances as well as submission of the parties, the prayer for bail of the petitioner in connection with Ishipur Barhat P.S. Case No. 147 of 2014 corresponding to Sessions Trial No. 741 of 2015 is, again rejected.

However, it is made clear that if trial of the petitioner

No.37429 of 2016 (4) dt.07-12-2016 2/2 is not concluded within four months from the date of receipt/production of copy of this order, the petitioner may renew his prayer for bail before the learned trial court itself. Let copy of this order be communicated to the Superintendent of Police, Bhagalpur with direction to him to ensure the presence of prosecution witnesses of the aforesaid case before the trial court without any delay.
