JUSTICE PURNENDU SINGH ORAL ORDER 17-12-2024 Heard Mr. Ramakant Sharma, learned Senior Counsel along with Mr. Mayank Raj and Mr. Avinash Kumar, learned counsels appearing on behalf of the petitioner and Ms. Dr. Indiwar Kumari, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 1008C of 2019 registered for the offence punishable under Sections 498A, 494, 379/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

3. The allegation against the petitioner is of assaulting

4. Both the parties have jointly informed that they are ready to reconcile their matrimonial relationship, outside the Court, by way of mediation.

5. Considering the nature of allegation, the matter can be negotiated between the parties. I find it proper to direct the learned Mediator, District Mediation Centre, to resolve the dispute between the husband and the wife and submit a report before the learned District Court, well within a period of three months.

6. Both the parties are directed to appear before the learned Mediator, District Mediation Centre on 07.01.2025 at 04:30 PM. The order has been passed in the open Court, in the presence of both the respective counsels, appearing on behalf of the respective parties.

7. The petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jamui/ successor Court, in connection with Complaint Case No. 1008C of 2019, subject to the condition as

Patna High Court CR. MISC. No.22407 of 2023(7) dt.17-12-2024 3/3 laid down under Section 438(2) of the Cr.P.C.

8. The bail application stands disposed of.
