The petitioner seeks regular bail in connection with Daudpur P.S. Case No.112 of 2018 registered for offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1B)a, 26 and 35 of the Arms Act.
Allegation as per FIR is that on information, some miscreants are preparing for committing dacoity. Petitioner was arrested by the police and one Katta and one cartridge was seized. Submission of learned counsel for the petitioner is that he has been falsely implicated in the case and he is in custody since 25.06.2018.
Heard learned A.P.P. also who has opposed the prayer for
Patna High Court Cr.Misc. No.62077 of 2018 (2) dt.12-10-2018 2/2 bail and stated that the petitioner is an accused in another case also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed with the direction that once the petitioner complete six months of custody, he shall be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Daudpur P.S. Case No.112 of 2018, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
