The petitioner is accused in connection with Ahiyapur P.S. Case No. 831 of 2018 registered under Section 498(A)/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
The accusation is of torturing the informant by her husband and in-laws due to non fulfillment of demand of dowry and removing her from matrimonial house in pregnant condition.
Learned counsel for the petitioner submits that petitioner is the husband of the informant and due to misconception the present case has been lodged by the wife of
Patna High Court Cr.Misc. No.62253 of 2018(2) dt.06-10-2018 2/2 the petitioner. It is further submitted that petitioner is in custody since 05.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 831 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
