This application for regular bail arises out of Birpur P.S. Case No. 85 of 2018 for the offences under Section 30 and 32 of Bihar Prohibition and Excise Act, 2016. The police are said to have, on the basis of a secret information, conducted raid and seized 346.5 liters of foreign liquor from three different places. Allegedly, on seeing the police party, five persons were found fleeing. It is the contention of the petitioner that no seizure was made form any place belonging to him and he has been implicated on the basis of disclosure made by the local people that the petitioner was also one amongst the persons, who had fled away. Considering the above submission, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge, Begusarai, in Birpur P.S. Case No. 85 of 2018.
