JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The impugned order goes to show that only informant, investigating officer and medical officer have been left to be examined and, therefore, taking note of the aforesaid fact as well as allegation leveled against the petitioner, again I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Session trial no. 57 of 2016 arising out of Basantpur P.S.Case No. 145 of 2014, pending in the court of learned Additional Sessions Judge 4th , Siwan stands rejected. However, the trial court is directed to conclude the trial of the petitioner within three months from the date of receipt/ production of copy of this order, failing which petitioner shall be at liberty to renew his prayer for bail before the learned court

Let a copy of this order be sent to the Superintendent of Police, Siwan with direction to him to ensure the presence of remaining prosecution witnesses before the trial court within a month from the date of receipt of this order, failing which the matter shall be viewed seriously.
