Petitioner seeks bail in Kahalgaon P.S. Case No.134 of 2017 instituted for the offence under Section(s) 363, 366-A, 376/34 Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the First Information Report. Name of petitioner has come in the statement of victim recorded under Section 164 Cr.P.C., which is Annexed as Annexure-4, wherein, she has alleged against this petitioner that he was also present with Akhilesh Kumar.
In the written report also, allegation has been levelled against Akhilesh Yadav.
In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.65595 of 2018(2) dt.22-11-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Bhagalpur, in connection with Kahalgaon P.S. Case No.134 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
