JUSTICE MADHURESH PRASAD ORAL ORDER 13-02-2018 Heard counsel for the petitioner, State and the Corporation.

The petitioner has approached this Court being aggrieved by non consideration of his application for appointment on compassionate ground since his father Late Syed Arshad Ali died in harness on 3.2.2000 while he was posted as Depot Store Keeper in Saharsa Depot of the respondent Corporation. He had made his application for compassionate appointment on 13.6.2000 and since then his application has not been considered.

Counsel for the Corporation submits that such applications of others pending since prior to the petitioner's application, were rejected on the ground of the Corporation

Patna High Court CWJC No.1567 of 2003 (3) dt.13-02-2018 being suffering from acute financial crunch.

Counsel for the petitioner submits that now the Corporation is not in financial crunch and is carrying out its business smoothly.

No counter affidavit has been filed by the Corporation till date.

Be that as it may, as the parties are in agreement, the writ petition is disposed of to enable the respondent Corporation to consider petitioner's claim and to take a final decision in accordance with law within a period of thee months from the date of receipt/production of a copy of this order without being prejudiced by the pendency of the writ petition for such a long time.
