The petitioner is apprehending arrest in a case registered for the offences punishable under Section 380/34 of the Indian Penal Code.
The prosecution case is that on theft being committed in the house of the informant, the FIR was registered against unknown. The name of the petitioner sprang up on the confession of co-accused. Subsequently, the alleged stolen Laptop was recovered from the house of this petitioner. It is submitted by learned counsel for the petitioner that the petitioner is running scrap shop and he was not aware about the alleged Laptop being stolen one.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.38459 of 2015 (2) dt.24-09-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lalganj P.S. Case No.71 of 2015, pending before the learned CJM, Hajipur at Vaishali.
With the above observation, this application is, accordingly, disposed off.
