The petitioners being the sister-in-laws (Gotni) of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.
The prosecution case is that the daughter of the informant was married with Santosh Yadav about 7-8 years prior to the occurrence, but subsequently she was subjected to torture since her husband had illicit relation with petitioner no. 1 from before and ultimately the daughter of the informant was done to death.
Patna High Court Cr.Misc. No.37008 of 2015 (2) dt.11-09-2015 2/2 It is submitted by learned counsel for the petitioners that the accusation is omnibus and general but from the accusation it appears that the thrust of accusation is against the husband of the victim.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhubani in connection with Benipatti P.S. Case No. 122 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
