2. The petitioner seeks bail in connection with Gwalpara P.S. Case No. 26 of 2023 dated 20.02.2023, instituted for the offences punishable under Sections 419 and 420 of the Indian Penal Code and Section 10 of the Bihar School Examination Board Act, 1981.

3. As per the FIR, allegation is made against the petitioner and other co-accused persons, who were appearing in the examination of Matriculation in place of other candidate.

4. Learned counsel for the petitioner submits that the petitioner is innocent and she is falsely implicated in this case. It is submitted that other co-accused persons, namely, Nitu Kumar,

No.20345 of 2023(2) dt.17-05-2023 2/2 Pushpa Kumari and Prachi Kumari have been granted bail by a Co-ordinate Bench of this Court passed in Criminal Miscellaneous No. 21070 of 2023, vide order dated 29.04.2023. It is further submitted that the petitioner is apprehended on the basis of suspicion only. Lastly, it has been submitted that the petitioner is in custody since 21.02.2023, has no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Udakishunganj, Madhepura in Gwalpara P.S. Case No. 26 of 2023.
