The petitioner seeks bail in Allouli P.S. Case No. 5 of 2011, corresponding to Sessions Trial No. 247 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that Ramjapo Singh requested him to facilitate to talk with his wife when the informant went to the house of Ramjapo Singh he found the petitioner and wife of Ramjapo Singh in compromising position. The petitioner assaulted the informant. The informant was in his house when the petitioner and other accused persons entered into the house and Bipin Singh is said to have fired at the chest of the informant.

Patna High Court Cr.Misc. No.54519 of 2016 (2) dt.16-01-2017 2/2 Learned counsel for the petitioner submits that no allegation of firing is against the petitioner and the petitioner is in jail since 08.07.2016. It appears that there is no allegation of firing against the petitioner, but the petitioner was absconding for about 5 years and he has remained in jail for six months. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IIIrd, Khagaria in Allouli P.S. Case No. 5 of 2011, corresponding to Sessions Trial No. 247 of 2016.
