Arif, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 14.06.2016 in Gaunaha P.S. Case No.74 of 2016 registered for the offence under Section 20 of the N.D.P.S. Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that about 20 1⁄2 Kg of Ganja was recovered from the house of the petitioner. Besides the aforesaid Ganja, seven Puriyas of Ganja weighing about 25 gms wrapped in paper were also recovered. He submits that the petitioner was not involved, rather
Patna High Court Cr.Misc. No.43660 of 2016 (2) dt.13-12-2016 2/2 her husband was involved in trafficking of ganja. On the aforesaid ground, a prayer has been made for extending the privilege of bail. Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.
Considering the recovery of Ganja, which is above commercial quantity, there is no reason to extend the privilege of bail. Accordingly, the prayer for bail of the petitioner stands rejected.
