JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bettiah Town P.S. Case No. 595 of 2016 registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that land belonging to the informant Kamakhaya Narayan Singh was sold by Shashi Yadav and Mani Bhusan Singh, both sons of Uday Narayan Singh petitioner no. 1 & 3. The petitioner no.2 Antu Yadav put his signature as a witness.

Submission is that the informant and co-accused

Patna High Court Cr.Misc. No.13465 of 2017 (2) dt.02-05-2017 2/2 Shashi Narayan Singh are agnates and co-accused Shashi Bushan Singh and Manibhusan Singh executed sale deed in favour of the petitioner no.1 and 3 claiming the same their own share, as such, petitioner nos. 1 and 3 are bona fide purchaser on which petitioner no.2 put his signature as a witness.

Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No. 595 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
