ANSARI) 19-01-2015 Heard Mr. Dhanendra Chaubey, learned counsel for the appellants, Mr. Satish Kumar, learned counsel for respondent No.1, and Mr. Sujeet Kumar Sinha, learned CGC, appearing for respondent No.2.

I.A.No. 15 of 2015 has been filed by the appellants, under Section 5 of the Limitation Act, seeking condonation of delay of 328 days in preferring the present letters patent appeal against the order, dated 28.10.2013, passed in C.W.J.C.No. 16484 of 2012.

Having considered the reasons assigned in the present petition seeking condonation of delay, in preferring appeal, and having heard the learned counsel for the parties, this Court is

Patna High Court LPA No.7 of 2015 (3) dt.19-01-2015 satisfied that the appellants were prevented by sufficient causes from preferring the appeal within time.

In view of the above, the delay of 328 days, in preferring the letters patent appeal, is hereby condoned. I.A.No. 15 of 2005 shall stand disposed of.

L.P.A.No. 07 of 2015 Heard learned counsel for the appellants, who submits that the appellants will make necessary application for review of the order, dated 28.10.2013, passed in C.W.J.C.No. 16484 of 2012, which is under appeal.

To the submissions so made, no serious objection has been made on behalf of the respondents.

In view of the above and in the interest of justice, this appeal shall stand disposed of with liberty to the appellants to approach this Court with appropriate application, in future, if so advised.
