JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 387/34 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that allegation against the petitioners is that they have demanded rangdari from the informant but as a matter of fact the petitioners have purchased the land and with respect to that there is a Title Suit pending in the court below. There was also a proceeding under Section 144 of the Code of Criminal Procedure and in retaliation the present case has been filed against the petitioners. Heard learned A.P.P. also. Patna High Court Cr.Misc. No.4730 of 2017 (2) dt.13-02-2017 2/2 opposed the prayer for anticipatory bail.

Heard both sides. From perusal of the impugned order itself it appears that a Title Suit is going on between the parties and a proceeding under Section 144 of the Code of Criminal Procedure was also initiated against the disputed land. Thereafter, a Criminal Revision has also been filed. As such, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Barauli P.S. Case no. 102 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local having property within the jurisdiction of the court concerned and petitioner shall cooperate in the investigation and make himself available before the police as and when required.
