JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has preferred this application for grant of regular bail in a case registered u/s 302 read with 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the petitioner and coaccused persons caught hold of the son of the informant and on the order of co-accused Dharmendra Singh, Aditya Kumar shot the son of the informant dead.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.21784 of 2022(2) dt.04-08-2022 2/2 case on mere suspicion. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. There is general and omnibus allegation against the petitioner. The petitioner is in custody since 28.02.2022. The co-accused Dharmendra Singh has already been granted regular bail by a Co-ordinate Bench vide order dated 19.07.2021 in Cr. Misc. No. 685 of 2021 and two other co-accused persons have been granted anticipatory Bail by a Co-ordinate bench vide orders dated 09.08.2021 passed in Cr. Misc. No. 5967 of 2021 and Cr. Misc. No. 7410 of 2021.

Learned A.P.P. for the State as well as learned counsel for the informant Adv. Sumit Kumar have vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra, in connection with Dariyapur P.S.
