JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Parbatta P.S.Case No. 188/ 2018, registered for offences punishable under Sections 147, 148, 149, 323, 324 and 307 of the Indian Penal Code.

Allegation against the petitioner as per F.I.R. is that the petitioner and other accused persons is of assault to the brother-in-law of the informant and son of the informant with lathi, causing injuries.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in the instant case and there is general and omnibus allegation against the petitioner and there is a case and counter case between the parties and injuries were found on the person of the brother-in-law of the

Patna High Court Cr.Misc. No.64411 of 2018 (2) dt.26-10-2018 2/2 informant, is simple in nature and injuries on the son of the informant is also simple in nature. It is further submitted that the petitioner has no criminal antecedent and other co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 16.08.2018 passed in Cr. Misc. No. 47829 of 2018. Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Khagaria in connection with Parbatta P.S.Case No. 188 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
