The petitioner seeks pre-arrest bail in connection with Belaganj P.S. Case No. 181 of 2018 for the offences alleged under Sections 341, 323, 325, 307, 337, 379 and 34 of the Indian Penal Code.

The accusation is that while the informant was returning from Railway Station, petitioner and his brother attacked on him, then, he fell down. Thereafter, he was assaulted by brick-batting and they also snatched gold chain and cash of Rs.2,000/-.

The submission of the learned counsel for the petitioner is that petitioner and his brother have been falsely implicated in this case due to land dispute. Further submission is that co-accused, Rahul Kumar, has already been allowed the

Patna High Court CR. MISC. No.20630 of 2019(4) dt.01-08-2019 2/2 privilege of pre-arrest bail vide Cr. Misc. No. 79362 of 2018 on 25.02.2019.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Belaganj P.S. Case No. 181 of 2018 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
