03-10-2016 Heard Sri Rajani Ranjan Prasad Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 07-12-2015 in Bihiya P.S. Case No. 183 of 2015 registered for offence under Sections 384/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner has been made accused on the confession of coaccused, whereas, co-accused, on whose confession petitioner was made accused, has already been granted bail. On this very ground, a prayer is being made for grant of bail. However, he accepts that the person, who was arrested, had disclosed that he had come for collecting ransom, as per instance of the petitioner. Learned
Patna High Court Cr.Misc. No.40904 of 2016 (2) dt.03-10-2016 2/2 counsel for the petitioner submits that at the relevant time, the petitioner was in custody in another case.
However, I have perused paragraph - 3 of the petition, which indicates that petitioner is accused in number of cases relating to serious offences and in this case, while the petitioner was in jail, on his instruction, the co-accused was apprehended on the ground of ransom.
Keeping in view the antecedent of the petitioner, I am not inclined to extend the privilege of bail. Dismissed.
