Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered u/s 379, 411 and 401 read with 34 of the Indian Penal Code.

As per the prosecution case, a tractor with its trailer was parked in the vacant land of Dr. Madhukar Kumar. But the said tractor and its trailer was missing on 26.12.2021. During search, a person was seen with the said tractor and its trailer. On chase, the said person fled away leaving his mobile .

Patna High Court CR. MISC. No.21793 of 2022(2) dt.04-08-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent as stated at para 3 of the bail petition. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up in the confessional statement of co-accused Rajesh Yadav. The petitioner is in custody since 29.12.2021 Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S. Case No.457 of of 2021.

The application stands allowed.
