2. The petitioner seeks bail in connection with Tatarpur P.S. Case No. 161 of 2024 instituted for the offences under Sections 126(2), 115(2), 117(2), 109, 352, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023.

3. As per prosecution case, all the accused persons including the petitioner assaulted the informant and her family members. It is further alleged that this petitioner assaulted on the head of the informant's husband due to which he sustained injuries.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. Learned counsel further submitted that the only allegation against the petitioner is that he assaulted with sword on the head of the informant's husband due to which he sustained injuries. Learned counsel further submitted that as per impugned order lacerated wound is caused on the head of the informant's husband which falsifies the case of the prosecution. Charge-sheet has been submitted in this case. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.10.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court
