The petitioner seeks bail in Kalyanpur P.S. Case No.94 of 2018 registered for the offence under Sections 392 of I.P.C. Accusation against the petitioner is of looting Bolero Pickup Van of the informant in the way.
Submission on behalf of the petitioner is that on the basis of written report informant Nirpendra Kumar Singh regarding the loot of one of loaded pickup van Kalyanpur P.S. Case No.94 of 2018 was instituted against 3 - 4 unknown. In course of investigation mobile of the petitioner was found in active condition near the place of occurrence thereafter the police arrested the petitioner and recorded his statement showing his involvement in the present case. Nothing has been recovered from
Patna High Court Cr.Misc. No.62491 of 2018 (2) dt.08-10-2018 2/2 the possession of petitioner and he is in custody since7.7.2018 having no criminal antecedent.
Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.
Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur, in Kalyanpur P.S. Case No.94/18.
