2. The petitioner apprehends arrest in a case registered for the offence punishable under section 302 of the Indian Penal Code and section 27 of the Arms Act.
3. It is alleged that some unknown miscreants entered into school office and shot dead son of the informant.
4. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Coaccused Suraj Kumar, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order dated 14.5.2019, passed in Cr.Mis.No. 32031 of 2019. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner,
Patna High Court CR. MISC. No.25116 of 2023(3) dt.13-07-2023 2/2 mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Vaishali at Hajipur in Bhagwanpur Police Station Case No. 75 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
