2. The petitioner apprehends arrest in connection with Special Case No. 7A/2012, arising out of Bhabua P.S. Case No. 533 of 2011, registered on 24.12.2011 for offences punishable under Sections 420, 409, 467, 468, 471, and 120B of the Indian Penal Code, as well as Section 13(1)(d) of the Prevention of Corruption Act.
3. As per the prosecution, the petitioner is alleged to
Patna High Court CR. MISC. No.21024 of 2025(2) dt.23-04-2025 2/3 have committed financial irregularities involving a substantial amount, running into crores of rupees.
4. Learned Senior Counsel for the petitioner submits that almost all co-accused in this case have been granted anticipatory bail, and hence, the petitioner also deserves similar consideration to ensure parity and equal treatment under law.
5. Learned counsel for the Vigilance Department opposes the prayer for bail and submits that the rejection order clearly indicates that processes under Sections 82 and 83 of the Cr.P.C. were issued against the petitioner as far back as 13.10.2017. It is further submitted that the delay in trial proceedings is primarily attributable to the petitioner's noncooperation.
6. In view of the above facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail in connection with Special Case No. 7A/2012, arising out of Bhabua P.S. Case No. 533 of 2011, pending before the learned Special Judge, Vigilance, Patna, stands rejected.
7. However, it is directed that the petitioner shall surrender before the Trial Court within a period of four weeks from today. Upon such surrender, the Trial Court shall consider
