JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-09-2022 The present writ petition has been filed seeking the following reliefs:- "(a) For issuance of writ of Mandamus, commanding the respondents concerned to remove encroachment over the Gair Mazurua Aam land which is being used by the villagers as road and for public purposes, situated at Mauza-Saidpur, Tauzi No-749, Thana No-660, Khesra No-178, Area-4 Katha, 10 dhur in Anchal Sahebpur Kamal, DistrictBegusarai. b) For issuance of Mandamus commanding the respondents to take immediate action under the Public Land Encroachment Act against the villagers
Patna High Court CWJC No.9557 of 2021(2) dt.23-09-2022 2/2 who are encroachers of the above public land and whose name have also figures in enquiry report of respondent no.7, namely 1. Shankar Singh, 2. Lakhan Singh, 3. Ravindra Singh and 4. Ram Sevak Singh all resident of ward no. 1, Anchal-Sahebpur Kamal, Sub Divisional Ballia, Dist.- Begusarai." At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer,Sahebpur Kamal, District-Begusarai, for redressal of his aforesaid grievance.
Liberty so sought is granted.
It is needless to state that in case the petitioner approaches the Circle Officer, Sahebpur Kamal, DistrictBegusarai, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
