JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 23-02-2016 Heard Mr. Siya Ram Shahi, learned counsel appearing for the petitioner, Mr. Binod Kumar, learned counsel for the Corporation and learned counsel for the State.

The petitioner is a Multi State Cooperative Society and is aggrieved by the action of the respondent-Corporation in nonpayment of his bills, the details of which find mentioned in Paragraph-1 of the writ petition. The bills were submitted in connection with the running and management of the short stay home within Nawada district. The petitioner had earlier come before this Court in CWJC No.1736 of 2013 and a co-ordinate Bench looking

Patna High Court CWJC No.19784 of 2014 dt.23-02-2016 into the grievance of the petitioner disposed of the writ petition with direction to the Managing Director of the Corporation to take a final decision on the pending claims. It is following such directives that the claim of the petitioner after consideration stands disposed of by the Managing Director which is manifest from a letter dated 26.6.2014 addressed to the District Magistrate, Nawada and whereby the Managing Director has informed the District Magistrate that of the bill submitted by the petitioner to the tune of Rs. 6,52,134/- while the bill for an amount of Rs.2,68,529/- was not found admissible, orders for payment of the balance of Rs.3,83,605/- have been issued. Mr.

Binod Kumar, learned counsel appearing for the Corporation informs that the payment has reached the petitioner and since the balance is disputed, hence the same cannot be allowed. Mr. Shahi, learned counsel appearing for the petitioner in the circumstances sought liberty for the petitioner to raise the remaining claim before the Corporation and prays for an appropriate direction to the Corporation to consider and dispose of the same. In my opinion the submission is reasonable and can be accepted. Since there are no reasons assigned by the Managing Director in her letter dated 26.6.2014 as to the reasons on which the bills to the tune of Rs.

Patna High Court CWJC No.19784 of 2014 dt.23-02-2016 Director along with the supportive document and which should be considered and disposed of by the Managing Director by a speaking order to be passed within a period of three months from the date of receipt/production of a copy of this order.

This writ petition is disposed of.
