NILU AGRAWAL ORAL ORDER 09-09-2015 Heard learned counsel for the petitioners Sri Pushpendra Kumar Singh along with Sri Rajeev Ranjan and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Runnisaidpur P. S. Case no. 254 of 2015 for the offence alleged under Sections 420, 406, 504, 506 and 34 of the Indian Penal Code.

The prosecution case is that to purchase the landed property with house of the informant on a consideration of Rs. 10,40,000/-, an agreement was entered into between the petitioners and the informant. But petitioners paid only Rs. 5,00,000/- and promised that rest of the amount will be paid at the time of registration. The petitioners prepared forged sale deed and got the signature of the informant but the balance amount of consideration money has not been paid rather informant was threatened to be killed along with her son.

He further submits that the informant has executed the sale deed along with her son and has received the entire consideration money and is a valid document. It has furthermore been submitted that dispute being civil in nature, the petitioners have been falsely implicated in the said case.

Under such circumstances, let petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P. S. Case no. 254 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
