JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Section 25(i)(a)/25(1-B), a/26(1)(2)/35 of the Arms Act.

It has been submitted on behalf of the petitioner that he has been falsely implicated in the present case and it is alleged that there is recovery of one country made pistol without any cartridges from the possession of the petitioner; the petitioner has remained in judicial custody for more than five months. Heard learned A.P.P. also.

Considering the facts and circumstances of the case, nature of offence and the period of detention, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.55486 of 2016 (2) dt.23-12-2016 2/2 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -II, Munger, in connection with Jamalpur P.S. Case No. 90 of 2016., subject to the condition that one of the bailors of the petitioner shall be his close relative having sufficient means within the jurisdiction of the concerned Court and the petitioner shall cooperate in disposal of trial and shall present himself on each and every day except for genuine reasons.
