JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Akbar Nagar P.S.Case No. 45 of 2018, registered, registered for the offence under Sections 25 (1-b)A/26 of the Arms Act. As per F.I.R. allegation against the petitioner is of recovery of one loaded country made pistol from the physical possession of the petitioner and further one country made pistol, one gun and 34 cartridges of 8 mm from the Basa of the petitioner were recovered and accordingly, a seizure list has been prepared. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing objectionable articles has been recovered from the possession of the petitioner and he is in custody since 31.05.2018
Patna High Court Cr.Misc. No.61962 of 2018 (2) dt.11-10-2018 2/2 and the petitioner has no concern with the alleged Basa. Heard learned A.P.P. also who opposed the prayer for bail.
Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody since 31.05.2018, the trial Court is directed to expedite the trial and try to conclude the same as soon as possible.
