Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 307, 504/34 of the Indian Penal Code.

It is alleged that the petitioners along with other accused persons assaulted the informant and his brother Pappu Kumar, due to which they sustained injury.

It is submitted on behalf of the petitioners that as per FIR, specific allegation is attributed against co-accused Rahul Kumar, Raja Kumar and Ambar. So far as these petitioners are concerned, there is no specific overt-act leveled against them.

Learned counsel for the State opposed the prayer for pre-arrest bail of the petitioners.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Beldaur P.S. Case No. 257 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
