JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 419, 420, 467, 471, 34 of the Indian Penal Code and Sections 30(a), 32(i), 32(ii), 41(i) of Bihar Prohibition and Excise Act.

Prosecution case is that 2190 litres of foreign liquor was recovered from the spot.

Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner is not the owner nor driver of the vehicle in question. Petitioner has got no criminal antecedent of similar nature.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.20405 of 2023(2) dt.15-05-2023 2/2 bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Excise Court 1st, Samastipur in connection with Bithan Police Station Case No. 164 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
