JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2018 The petitioner seeks regular bail in connection with Daudnagar P.S. Case No. 256 of 2018, registered for offences punishable under Sections 304(B)/201 and 34 of the Indian Penal Code.

Petitioner is husband of the deceased and allegation is of committing dowry death of the deceased.

It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R. and he has falsely been made accused in this case and at the time of occurrence, he was at Gujarat in connection with his job and save and except the fact that his name has come in supervision note, there is absolutely nothing against the petitioner and he has been in judicial custody since 29.08.2018.

Patna High Court Cr.Misc. No.63049 of 2018 (2) dt.12-10-2018 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstance of the case and also the fact that investigation is still going on, I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.

However, the petitioner is at liberty to renew his prayer for bail before the court below once charge-sheet is submitted against the petitioner and if any such application is filed, the court below shall consider the same and pass an appropriate order, without being prejudiced by the order of this Court.
