The petitioner is languishing in custody since 09.05.2016 in connection with Muzaffarpur Town P.S. Case No. 612 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 325, 307, 436, 435, 452 and 380 of the IPC. The prosecution story, in brief, is that the petitioner and several other FIR named accused as well as 20-25 unknown persons are said to have assaulted the informant as well as her other family members as a result of which the informant and some other sustained serious injury.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.53551 of 2016 (2) dt.09-01-2017 2/2 petitioner is in custody since 09.05.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. The other co-accused have been granted bail by another co-ordinate Bench of this Court vide Annexure-3 series to the present application. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No.612 of 2015.
