JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.01.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 2160 litres of liquor from various vehicles as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner is neither the driver nor the owner of the alleged vehicle and was a mere passerby who came to be implicated when the search was made.

Patna High Court CR. MISC. No.20496 of 2022(2) dt.29-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 10.01.2022, is a person with clean antecedent, chargesheet has been submitted in the case and is neither the driver nor the owner of the vehicle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Danapur P.S. Case No. 29 of 2022.
