1. Heard the learned counsel for the petitioner and the learned APP Mr. Jharkhandi Upadhyay along with the learned Senior counsel appearing on behalf of the O.P. No.2.

2. The learned counsel for the petitioner after some arguments seeks permission to withdraw the anticipatory bail application with liberty to seek regular bail, as it has been submitted by the learned senior counsel appearing on behalf of the complainant that process under section 82 Cr.P.C. was issued on 05.12.2023 and the anticipatory bail application of the petitioner was rejected by the learned District Court on 17.07.2023, and thereafter, the petitioner moved this court in March, 2024 which amply demonstrates that petitioner after the

Patna High Court CR. MISC. No.25667 of 2024(3) dt.24-06-2024 2/2 anticipatory bail was rejected by the learned District Court did not approach this Court seeking anticipatory bail within a reasonable time.

3. At this stage, learned counsel appearing on behalf of the petitioner submits that the dispute is purely civil to which a criminal colour has been given, on which, the learned senior counsel appearing on behalf of the O.P. No.2 submits that petitioner was not diligent in approaching this Court in time, which led to issuance of the process under section 82 Cr.P.C.

4. At this stage, learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application of the petitioner.

5. Permission is accorded.

6. However, if the petitioner surrenders on or before 22.07.2024, the learned trial court shall try to dispose of the case on the same day.
