JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 307, 379, 504, 120B of the Indian Penal Code, 27 of the Arms Act and 3 and 4 of The Explosive Substances Act, 1908.
The prosecution case is that while the informant was shutting his jewellary shop, one bomb exploded on the road when the informant came at the door of his shop then another bomb exploded. It is further alleged that when informant rushed to his house, in the meantime, someone resorted to fire on him when suspicion was raised against petitioner and co-accused Prem Ojha as either one of them might have committed the offence. It is submitted by learned counsel for the petitioner that due to earlier enmity suspicion has been raised against the petitioner. Obviously, no injury was caused to the informant.

No.37203 of 2015 (2) dt.14-09-2015 2/2 Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Goh P.S. Case No.45 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
