The petitioner apprehends his arrest in Complaint Case No. 302/2012, registered for the offences punishable under Section 420 of the Indian Penal Code and 138 of the N.I. Act. The petitioner is alleged to have issued a cheque of Rs. 3,39,455/- to the complainant and the cheque was dishonoured due to insufficient amount in the account of the petitioner. It is submitted that the petitioner was business partner of the complainant. The complainant misused the cheque of the petitioner. The petitioner never took any money from the informant nor issued any cheque for repayment of loan. Notice was issued to the complainant, but nobody appeared.

No.38880 of 2015 (3) dt.17-12-2015 Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Complaint Case No. 302/2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
