JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-08-2022 Learned counsel for the petitioners is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners have preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, it is alleged that one loaded country-made pistol and live cartridges were recovered from the pocket of the Petitioner No. 2 Niranjan Kumar and two

Patna High Court CR. MISC. No.21015 of 2022(2) dt.04-08-2022 2/3 .315 bore live cartridges were recovered from the possession of the Petitioner No. 1 Ram Gulam Kumar.

Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. No incriminating article has been recovered from the possession of the petitioners. The petitioners are also accused in three other criminal cases as stated at para 3 of the bail petition while the impugned order suggests that there are four other criminal cases. The petitioners are in custody since 29.11.2021. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna City, in connection with Khusrupur P.S. Case No. 317 of 2021.

The application stands allowed.
