2. The petitioners are apprehending their arrest in connection with Shahpur Patori P.S. Case No. 379 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 117(2), 110/303(2), 74, 352,351(2),3(5) of the BNS.

3. On account of a trifle, allegedly the petitioners assaulted the informant and other persons, due to which they sustained serious injury. There is specific allegation against the petitioner no. 1 of causing assault over the head of the informant

4.Learned Advocate for the petitioners submitted that so far the petitioners no. 2 and 3 are concerned, there is omnibus nature of allegation and moreover the allegation levelled against the petitioner no. 1 of causing assault over the informant by means of iron rod which resulted into injury clearly suggests that the informant has sustained simple injury. The alleged occurrence took place on 17.09.2025 but the present FIR came to be instituted on 19.09.2025. The petitioners are carrying fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the in the said occurrence besides the informant, other persons have also sustained injuries.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the fact that the injury attributed to petitioner no. 1 appears to be simple in nature, besides the omnibus nature of allegation against the petitioners no. 2 and 3 as also their fair antecedent, let the petitioners abovenamed be released on bail, in the event

No.28866 of 2026(3) dt.15-07-2026 3/3 of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Shahpur Patori, Samastipur in connection with Shahpur Patori P.S. Case No. 379 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
