Petitioner being the husband of the informant is languishing in custody since 10.05.2016 in a case registered for the offences punishable under Sections 498A, 307 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The prosecution case is that the informant was married with the petitioner one year prior to lodging of the case. Immediately after the marriage, further demand of dowry was made. The petitioner used to assault the informant. It is specifically alleged that on 09.05.2016 when the informant along with his cousin sister was cutting grass then this petitioner inflicted dagger injury on the abdomen of the informant.
Patna High Court Cr.Misc. No.44191 of 2016 (2) dt.24-10-2016 It is submitted by the learned counsel for the petitioner that marginal size injury simple in nature has been found on the victim and investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) P.S. Case No. 131 of 2016.
