I find that repeated adjournments have been taken by the Petitioner and at one stage he was required to file an affidavit with regard to the stage of trial. Even that has not been done.

The Petitioner seeks quashing of the order of cognizance dated 15.07.2008 passed by the Judicial Magistrate, 1st Class, Danapur, Patna in Complaint Case No. 237(C) of 2008.

Considering that the Petitioner seeks quashing on disputed questions of fact which can not be gone into at this stage, I am not inclined to interfere in the matter.
