The petitioner is accused in connection with Sursand P.S. Case No. 225 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Excise Act.
The accusation is that petitioner and one Shravan Mahto were seen carrying the gunny bags in their heads. On chased by the informant and other police officials, both started to flee away throwing their gunny bags but both were apprehended and on search, 68 litres Nepali Sofiea kept in each bags in different bottles were recovered.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.62290 of 2018(2) dt.06-10-2018 2/2 petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner is accused in one antoher case, in which, he is on bail and in the present case, he is in custody since 18.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J-II-Cum- Special Judge Excise Act, Sitamarhi, in connection with Sursand P.S. Case No. 225 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
