JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the learned counsel for the North Bihar Power company Limited. The petitioner is accused in connection with Bagaha (Patkhouli) P.S. Case No. 242 of 2016, registered under Sections 406, 420 and 409 of the Indian Penal Code.

The accusation is that petitioner was provided Village Revenue Franchises of Electricity Department and also handed over three revenue receipt books but petitioner did not deposit the collected amount from 700 electric consumers and also did not deposit the collection book to the office. As such, petitioner committed forgery and grab the money, which was received from

Learned counsel for the petitioner submits that it would appear from Annexure 2 to the petition that Ram Murat Singh, brother of the petitioner, has deposited Rs. 2,17,663/- as collected by the petitioner from the electric consumers along with interest Rs.20932/-, regarding which, a certificate has been issued by the Assistant Electric Engineer, Electric Supply Division, Bagaha, West Champaran, through letter No. 473 dated 11.11.2016. It is further submitted that petitioner has no criminal antecedent and is in custody since 26.10.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha (Patkhouli) P.S. Case No. 242 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
