JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 This is an application for grant of anticipatory bail for offences punishable under Section 47A of the Bihar Excise Act, 2015.

Allegation against the petitioners is that from the house of Piru Manjhi 80 litres Mahua wine and from the house of Chandar Manjhi 65 litres Mahua wine was recovered. Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that they have got no criminal antecedent and nothing has been recovered from their house.

Heard learned A.P.P. also.

Having heard both sides, in view of recovery of

Patna High Court Cr.Misc. No.16783 of 2017 (2) dt.17-04-2017 2/2 Mahua wine from the house of the petitioners, I am not inclined to grant anticipatory bail to the petitioners, the same is rejected. However, petitioners may surrender in the court below, i.e., learned C.J.M., Gaya, in connection with Muffasil P. S. Case no. 376 of 2015 and make prayer for regular bail which will be considered after perusing the materials available on record without being prejudiced by the order of this Court. This application stands disposed of.
