JUSTICE SHIVAJI PANDEY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through Virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Pachrukhi P.S. Case No. 55 of 2020, registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2016.
As per allegation, about 475.200 literes of foreign liquor has been recovered from the Bolero vehicle and the petitioner has been arrested by the police, however, counsel for the petitioner submits that the petitioner is in judicial custody since 2.03.2020 having no criminal antecedent. Looking to the quantity of liquor recovered, this Court is not inclined to grant bail to the petitioner for the present.
Patna High Court CR. MISC. No.19187 of 2020(2) dt.10-06-2020 2/2 Accordingly, the prayer for bail is rejected for the present.
However, the petitioner may renew his prayer for bail after six months of his judicial custody.
