The petitioner seeks bail in connection with Daniyawan P.S. Case No. 98 of 2018, registered under Sections 411 and 414/34 of the Indian Penal Code. The accusation is that in course of patrolling duty informant received information that Bimal Bind of Barbatta village had kept two theft motorcycles concealing in the hut. Thereafter, informant and other Police officials reached in village Barbatta and apprehended one person and two motorcycles, who disclosed his name as Bimal Bind. On query, the apprehended person did not produce any paper regarding the seized motorcycles and he also disclosed that he has sold one motorcycle to the Nandlal Manjhi on the payment

Patna High Court Cr.Misc. No.62348 of 2018(2) dt.06-10-2018 2/2 of Rs. 8000/-. The said Bimal Bind also disclosed that he has handed over four motorcycles to the petitioner for selling of the same out of which one motorcycle is still with the petitioner. Thereafter, informant and other Police officials reached at the house of the petitioner and found one motorcycle standing at the house of the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion as the said motorcycle is said to be recovered at the road situated in front of his house. Further submission is that after remand in the present case, the petitioner has also been implicated in Agamkuan P.S. Case No. 548 of 2018, registered under Section 379 of the Indian Penal Code.

The petitioner in in the custody, in the present case, since 08.08.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV, Patnacity, in connection with Daniyawan P.S. Case No. 98 of 2018.
