JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-11-2022 The present writ petition has been filed seeking the following reliefs :- "(i) For quashing part of memo no. 405 dated 29.10.2018 so far as it relates to respondent no. 8 at serial no. 12, issued under the signature of Block Education officer, Amarpur, Banka, whereby and whereunder respondent no. 8 has been promoted to the post of Headmaster Middle School, Chapri, PS-Amarpur, District-Banka inspite of the fact that an FIR bearing

Patna High Court CWJC No.9628 of 2021(2) dt.15-11-2022 2/2 Amarpur pS case no. 64/14 dated 04.03.2014 has been instituted against respondent no. 8 under Sections 467/468/471/409/420 of the Indian Penal Code.

(ii) To direct and command the respondent authorities to take appropriate action against respondent no. 8 who was made accused in Amarpur PS case no. 64/14 and has been promoted to the post of Headmaster in connivance with the respondent authority."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 2 i.e. the Principal Secretary, Education Department, Bihar, Patna for redressal of his aforesaid grievances. Liberty so sought, is granted.

The writ petition stands disposed off.
